<p>Those organizations that are nonprofit have a legal obligation to provide education and counseling. </p>
<p>But not all credit counseling organizations provide these services. Some charge high fees, not all of which are disclosed, or urge you to make â??voluntaryâ? contributions that can cause you to fall deeper into debt. Many claim that a debt management plan is your only option before they spend time reviewing your financial situation, and offer little or no consumer education and counseling. Others misrepresent their nonprofit status or fraudulently obtained nonprofit status by misrepresenting their business practices to regulators. </p>
<p>The Federal Trade Commission (FTC), the nationâ??s consumer protection agency, and some state Attorneys General have sued several companies that called themselves credit counseling organizations. The FTC and the states said these companies deceived consumers about the cost, nature, and benefits of the services they offered; some companies even lied about their nonprofit status you can visit www.change-ur-mind.com several of these companies are now going out of business. Similar companies also may be shutting their doors, even though they havenâ??t been sued by the FTC or the states. That could be of special concern if you have a debt management plan with one of these companies. </p>
<p>Must-dos for anyone with A DMP </p>
<p>Organizations that advertise credit counseling often arrange for consumers to pay debts through a debt management plan (DMP). In a DMP, you deposit money each month with a credit counseling organization. The organization uses these deposits to pay your credit card bills, student loans, medical bills, or other unsecured debts according to a payment schedule theyâ??ve worked out with you and your creditors. Creditors may agree to lower interest rates or waive certain fees if you are repaying through a DMP. </p>
<p>The FTC has found that some organizations that offer Damps have deceived and defrauded consumers, and recommends that consumers check their bills to make sure that the organization fulfills its promises. If you are paying through a DMP, contact your creditors and confirm that they have accepted the proposed plan before you send any payments to the organization handling your DMP. Once the creditors have accepted the DMP, it is important to: </p>
<p>- make regular, timely payments. </p>
<p>- Always read your monthly statements promptly to make sure your creditors are getting paid according to your plan. </p>
<p>- contact the organization responsible for your DMP if you will be unable to make a scheduled payment, or if you discover that creditors are not being paid. </p>
<p>You need to be aware that if payments to your DMP and creditors are not made on time, you could lose the progress youâ??ve made on paying down your debt, or the benefits of being in a DMP, including lower interest rates and fee waivers. Although creditors may have forgiven late payments that you made before you began the DMP, the creditors may be unwilling or unable to do so if payments are late after you have enrolled in a DMP. If you fall behind on your payments, you may not be able to have your accounts â??re-agedâ? again (reported as current), even if you start a new DMP with a new counselor. <p>If your credit counselor has gone out of business </p>
<p>what happens to your DMP if the credit counseling company that managed your debts shuts down? A counseling agency that is going out of business may send you a notice telling you that your DMP is being transferred to another company. Or it may tell you that you need to take some action to keep your financial recovery on track. If a government agency has filed an action against your credit counseling company, you may get a notice from a third party. If you discover that the organization handling your DMP is going out of business you need to: </p>
<p>- contact your bank to stop payment if you are making your DMP payments through automatic withdrawal. </p>
<p>- start paying your bills directly to your creditors. </p>
<p>- notify your creditors that the organization handling your DMP is going out of business. </p>
<p>- consider working out a payment plan with your creditors yourself. Ask if they will give you a reduction on your interest rate without a DMP. </p>
<p>- order a copy of your credit report. Check for late payments â?? or missed DMP payments â?? that may result from the company going out of business. If you see â??lateâ? notations you donâ??t expect, call the creditor immediately and ask that the notation be removed. Understand that they have no obligation to do it. </p>
<p>If payments are late because the organization handling your DMP has failed to make scheduled payments, the consequences can be just as devastating as if you failed to make payments to the DMP. If you do not act quickly to make arrangements with your creditors, you could incur late charges that increase your debt, lose the lower interest rates associated with the DMP, and have â??lateâ? marks on your credit report.</p>

<p>What is a credit and debt counseling service?  A credit counseling service (or debt counseling service, or debt consolidation service) is an organization that does exactly what it sounds like: They provide advice and assistance to people who either need help with a poor credit rating or want to make sure they avoid credit pitfalls.</p>
<p>Often these companies claim to be nonprofit organizations.  We associate the term “nonprofit” with charities and benefactors, you know, the people who help others just for the sake of helping others.  These companies suck you in further by using the term ”counseling”.  A counselor sounds more comforting than advisor or attorney, doesn’t it?  It sounds like someone you can trust.  Can they really help?  Yes, sometimes.  But, if you are savvy, you can do most of the work on your own. </p>
<p>These companies claim:</p>
<p> To be nonprofit.  Some are, but most are not.  If they really were, they would be tax exempt under American law.  The fact is that the IRS has found that most of the credit counseling services DO NOT fit the definition of a true nonprofit organization according to the law. Thousands have benefited from their assistance.  Who are these thousands?  What does “benefited” actually mean?  Do you know anyone who has actually benefited from this service or are you just relying on the testimonials of the television?  What exactly are they going to do for you?  Could you do the same thing for yourself for free? They have a special relationship with creditors.  Not true.  Creditors work through the three main bureaus.  When they say that they have a “special” relationship with the creditors, all they mean is that they have sent out a lot of letters trying to negotiate debt settlement with many creditors.  In some cases, this may actually work against you; creditors and bureaus recognize the company’s name and pitch their letters straight in the trash.  You get a free consultation.  Okay, so in most cases, the consultation is free; in the same way timeshares offer “free” vacations. 
<p> </p>
<p>Here is what actually happens:</p>
<p> You go for your free consultation and the company gets all of your credit and debt information. They sit down with you and give you the shiny, rose-colored picture, demonstrating all the benefits of their service and how long it will take to be “debt-free”. That is where the consultation ends.  It was just that; a consultation.  If you want them to do anything at all, now you have to pay.  The most common fees are $5.00 or a flat fee of $39.95 per month.  Either way adds up fast.  Do not make the mistake of thinking you only have to pay this for a few months.  You most likely will be paying this for YEARS.
<p> </p>
<p>So far these companies are acting unethically, but not illegally.  They are in business to make money.  Eventually, they do generally deliver what they have promised.</p>
<p>But, sometimes these companies become downright underhanded.  For example, some of these companies receive commissions from YOUR creditors.  It is to the creditor’s benefit that you pay off your loan; so, behind your back, your creditor might pay a portion of your loan to your debt counselor, while you still pay them.  Keep in mind, that all that they have really done is send a letter.  Something you could have done all by yourself. </p>
<p>Some of these creditors might also pay monthly fees to these companies.  So, that it is in their best interest to stretch out your payments for as long as possible.</p>
<p>Even if you are working with a perfectly legitimate debt counseling service, you are still better off doing this on your own.  The reason is that you are more capable of looking over your record and deciding which accounts would be better left alone.  The debt consolidation companies have a policy: they have to close all your accounts.  Even if you have derogatory items on these accounts, having “all” of them closed (with a notation that they were closed with the assistance of a debt counselor) is NOT going to improve your credit rating.</p>
<p>All they are really doing is negotiating a consolidation loan, a loan that consolidates all of your payments into one loan.  That’s not a bad thing.  It can save you a lot of money in interest.  However, you could go to a bank and apply for a consolidation on your own, then close out your own accounts by paying them off if you want to.  That way you avoid not only the middleman and the fees, but also the notation on your credit report that you used a debt counselor.</p>
<p>So, when you make the decision on whether or not to use these companies, remember this: Some of these organizations are legit and some are not and all of them can have a negative impact on your credit for years to come.  So, why use them?  They cost you lots of money, potentially mess up your credit rating, and all this for what?  To save you the trouble of writing letters and licking stamps?  YOU can do it yourself and save the headaches.  You make the decision!</p>

<p>The first thing to realize when you are looking at a debt consolidation situation is that the nonprofit debt consolidation companies do the same things as you do.  They call the companies to whom you owe money and negotiate a repayment plan with them.  This is something which you are capable of doing yourself if you take the time to sit down and learn more about your finances and how you can pay off your debt.  If you go to your local library and search for the subject debt, you should be able to find four or five different books which you can help you in learning how to repay your debt.  This can be a very good exercise for you as you will get a chance to learn how to work on how to get yourself out of debt which can be a source of pride if you are able to do this without any help. <p>From our contact page the other day we were asked if we could recommend a nonprofit debt consolidation company. The short answer to the question is that there is no such thing as debt consolidation not for profit.</p>
<p>Of course there are companies out there that might call themselves non-profit debt relief companies. These companies may offer a range of services from consolidation loans to debt settlement, or even bankruptcy services. The problem is that they may call themselves non-profit companies, but most likely you&#8217;re being misled.</p>
<p>When it comes to debt consolidation specifically there are really two types of companies out there. There are those who lend you their own money and those who borrow money from others and relend it to you. In either case there is interest charged on the supposed nonprofit consolidation loan that you take out, and fees are usually charged for acquiring the loan itself. Herein, of course, lays the problem.</p>
<p>The consolidation company calls itself non-profit, but they still collect interest on the loan, and they do profit from that interest. In many cases they pay out huge salaries to the directors of the company so that can maintain their non-profit status.</p>
<p>The qualifications to become a nonprofit organization in the US aren&#8217;t really that strict. Basically all you need to do to get nonprofit status is create a company that doesn&#8217;t specifically earn money (it was created as a corporation, but not intended to profit as a corporation).
